Compensation special purpose act for businesses affected by COVID-19

On Friday, the Senate of the Republic of Poland adopted a draft compensation special prupose act, providing for a simplified route for entrepreneurs affected by COVID-19 to seek compensation. We are pleased to have been able to work on this bill together with Senator Krzysztof Kwiatkowski, Chairman of the Legislative Committee and entrepreneurs whose businesses had been closed due to COVID-19.

On 2 February 2021, our law firm, acting on behalf of dozens of Polish fitness club operators, filed the first part of pre-litigation summonses to the State Treasury to unfreeze fitness industry and pay damages to the Prime Minister's Office. The summonses are a prelude to a class action lawsuit being prepared by LWW.

However, the question arises whether, once the airline industry resumes its operations, it will be able to bear such a regime of liability that is so beneficial to passengers and whether these provisions should not be limited to the time of recovery from the crisis.
