Demonopolisation and rebuilding of a competitive market for ground services and the supply of aviation fuel

We advised the management of Poland’s largest airport in a process aimed at breaking up a monopoly on the supply of aviation fuel. The monopoly had led to very high prices compared with those at other European airports, which was hindering the development of the airport and diminishing its ability to attract carriers. Our activities included representation before courts; the private enforcement of competition law; obtaining the support of international aviation organisations; real estate transactions; and organising a competitive procedure for selecting the operator of the centralised fuel infrastructure (in a concession model). This led to the breakup of the monopoly and a permanent change in the model under which fuel is supplied to the airport. We are currently handling a similar project on a smaller scale at another leading Polish airport.
