We advise a foreign concern in connection with an investment on the Polish market. That investment, which largely concerns commercial activity, was threatened by the State Treasury, which, seeing the enormous potential of the market, began taking measures aimed at taking over our client’s main competitor. The project also involved such issues as: the permissibility and conditions of the State Treasury becoming involved in commercial activity; competition law; issues related to public aid; the protection of investments based on international agreements for the support and protection of investments; and issues from the areas of M&A and corporate affairs.
